A string of recent cases has emerged in which state disability laws have been the basis of employer liability. In those cases, employers disciplined or fired employees for positive drug tests where the test resulted in a positive due to prescription drugs and an employee’s need to take them due to an ailment considered a disability under state law. As you’ll see, such employer action turned out to be a huge, and costly, mistake. In other words, keeping your eye focused only on the ADA, and ignoring related state rules, may cost you a ton of trouble - and a fortune.
